Who we are and what these Terms cover
TinyPixel is operated by Hexashield Ltd., a company federally incorporated in Canada (“Hexashield”, “we”, “us”). These Terms of Use (“Terms”) govern your access to and use of https://tinypixel.app and the tools available on it (the “Service”). By using the Service, you agree to these Terms. If you don’t agree, please don’t use it.
Our Privacy Policy forms part of these Terms and describes how we handle your information.
What the Service is
TinyPixel is a set of free, in-browser image tools (such as converters, compressors, and editors). The tools run entirely on your device. We don’t require an account, we don’t charge for use, and we don’t place a watermark on your output.
Eligibility
The Service is not directed at children under 16, and you may only use it if you are 16 or older. By using the Service, you represent that you meet this age requirement.
Acceptable use
When you use the Service, you agree not to:
- Use the Service for anything illegal, or to process content that is illegal where you are or where we operate.
- Use the Service to process, create, or distribute content that infringes someone else’s rights, including copyright and trademark.
- Use the Service to process, create, or distribute child sexual abuse material, content that depicts non-consensual sexual activity, or content that exploits or endangers minors.
- Use automated tools, scripts, or bots in a way that degrades the Service for other users, exceeds reasonable use, or is intended to scrape, mirror, or replicate the Service.
- Reverse-engineer, decompile, or attempt to extract the source code of any part of the Service that is not already published, or republish the tools or their underlying code as your own product.
- Use the contact form to send spam, malware, or other abusive content.
We may suspend or block access to the Service if we reasonably believe you’ve broken these rules.
Your files and your output
You retain all rights to the files you process with the Service. Because the tools run on your device, we don’t see, store, or claim any rights to those files.
You also own any files the Service produces from your input. You may use that output however you like, including for commercial purposes. You are not required to credit us, and you don’t need our permission to use your output.
You are responsible for making sure you have the rights to the files you put into the Service.
Our intellectual property
The Service itself, including the TinyPixel name, logo, site design, written content, and the proprietary parts of the underlying code, is owned by Hexashield or its licensors and is protected by intellectual property laws. Some of the libraries and components we use are open-source and are governed by their own licences.
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for its intended purpose. Nothing in these Terms transfers any of our intellectual property rights to you.
Third-party services and advertising
The Service may rely on third-party providers for hosting, analytics, anti-abuse measures, and advertising, and may link to third-party websites. Those third parties operate under their own terms and privacy policies, which we don’t control.
Some pages of the Service display advertising served by third-party providers. We aren’t responsible for the content of those ads or the products and services they promote. For details on the data those providers may collect, see our Privacy Policy.
Disclaimer of warranties
The Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by law, we disclaim all warranties, including the implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability.
We don’t guarantee that the Service will be uninterrupted, error-free, or compatible with every device or browser, or that the output of any tool will meet your requirements. You use the Service at your own discretion and risk.
Limitation of liability
To the maximum extent permitted by law, Hexashield and its directors, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising from or related to your use of the Service.
Our total aggregate liability for any claim arising from or related to the Service is limited to the greater of (a) the total amount you have paid us in the twelve months before the claim (which, for the free Service, is CAD $0) and (b) CAD $0.
Some jurisdictions don’t allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
Indemnification
You agree to defend, indemnify, and hold harmless Hexashield and its directors, officers, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, the files you process through it, or your breach of these Terms.
Service changes and availability
We may add, remove, change, suspend, or discontinue any part of the Service at any time, with or without notice. We may also impose limits on certain features or restrict access to parts of the Service. We aren’t liable to you or any third party for changes, suspension, or discontinuation of the Service.
Termination
You can stop using the Service at any time. We may suspend or terminate your access to all or part of the Service if we reasonably believe you have broken these Terms or for any other lawful reason. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnification, and governing law) will survive.
Governing law and disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply in it, without regard to conflict-of-laws rules. The courts located in Toronto, Ontario have exclusive jurisdiction over any dispute arising out of or related to these Terms or the Service, and you consent to the personal jurisdiction of those courts. If you live in a jurisdiction whose laws give you mandatory local protections, nothing in this section overrides those protections.
Changes to these Terms
We may update these Terms from time to time. If we do, we’ll post the updated version here with a revised “Last updated” date. For significant changes we’ll surface a notice on the site before they take effect. Continued use of the Service after a change is posted means you accept the updated Terms.
Severability and entire agreement
If any part of these Terms is found to be unenforceable, the rest will remain in effect. Our failure to enforce any part of these Terms isn’t a waiver of our right to do so later. These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Service and replace any earlier agreements on the same subject.
